AUCTION TERMS AND CONDITIONS

 

The terms and conditions of this auction will be governed by the Contract for Sale of Real Estate (here-in called the Purchase Agreement.) The following terms are a summary provided for the convenience of the bidder. A sample purchase agreement is available from the auction company in the bidders packet and should be reviewed prior to the auction. All properties sell “AS IS WHERE IS” with no warranties of any type expressed or implied as to the merchantability, usability, fitness for a particular purpose, or any matter of whatsoever type or nature. Any improvements, which must be made, are the responsibility of the purchaser. All information advertised or stated was derived from sources believed correct, but is not guaranteed. All property dimensions are only approximation; Purchasers shall rely entirely on their own information, judgment, and inspection of the property and record. In the event both parcels are purchased by the same entity, no land division shall occur. In the event each parcel is purchased by separate entities, the Seller shall apply for the Land Division with the local unit of government and upon approval Seller shall provide a staked survey of Parcel A. All separate parcel sales shall be contingent upon the approval of the local unit of government and the Seller reserves the right to make reasonable adjustments to the proposed boundaries to accommodate creation of the Land Division. Seller retains all 2010 cropland rent and cropland renter retains the right to cultivate and harvest 2010 crop. In order to bid at the auction, prospective Purchasers will be required to sign a waiver eliminating the opportunity to conduct a risk assessment or inspection for the presence of lead based paint and/or lead paint hazards after the auction. Purchasers can inspect prior to the auction. The Real Estate will be sold free and clear of all liens. The Real Estate will be sold subject to any easements and building and use restrictions of record. Any announcement made at the auction site takes precedence over printed material.

 

DEPOSIT FOR REAL ESTATE:   A total of ten percent (10%) of the bid price is required at the Auction. Cash, cashiers check or personal checks are accepted for the deposit. This deposit in NOT refundable if the Purchaser does not carry through with the purchase. Your bidding is not conditional upon financing, so be sure you have arranged financing if needed and are capable of paying cash at the closing. OPEN FOR VIEWING:   Thursday July 22 nd & Thursday July 29 th from 6:00 PM to 7:00 PM . Other times by appointment.

 

CLOSING TERMS:    Balance of purchase price due at the closing within 45 days. Estimated 2010 property taxes will be prorated between the Purchaser and Seller. Possession will be given at the closing. Seller shall provide an owner's title insurance policy in the amount of the purchase price. Closing will be held at Title Company. Closing fees of approximately $250.00 will be divided evenly between the Purchaser and the Seller. Purchaser shall take possession of the property at Closing, subject to the rights of the cropland tenant. Real Estate sells subject to owner's confirmation, within 72 hours of auction completion.

 

BUYERS NOTE:   If you are the successful bidder, you must go to the closing table to sign all Purchase Agreement documents immediately following the conclusion of the Auction. At that time your check will be endorsed as a non-refundable deposit on the Real Estate. Individual's purchases are to be considered as singular transactions, NOT contingent on any other purchases or properties on the Auction. That ability to obtain financing is NOT a contingency of the sale. The Auction will be conducted at the sole discretion of the Auctioneer and any bids be recognized at their discretion.
